I'm Daniel, and years ago I self-excluded from gambling because I suffered from compulsive gambling. I thought I was safe... until one day an Instagram ad led me to an online casino that was giving me €50. I fell back in. I made more than 300 transactions in just three months, for a total of more than €17,000. The worst part: that casino is ILLEGAL in Spain.

📉 The bank knew this. It still processed all the payments.

Not a single call. Not a single alert. Not a single block.

At first, they refunded my money because it was an illegal company… but days later they reversed everything without notifying me, leaving my account in the red.

I've submitted evidence, the complaint, my self-exclusion... and I still have no clear answer.

📩 I'm fighting alone against two giants: Banco Santander and Mastercard, who allow these unlicensed operators to use their networks and continue destroying lives.

Soy Daniel, y hace años me autoexcluí del juego porque sufría ludopatía. Pensé que estaba a salvo… hasta que un día una publicidad en Instagram me llevó a un casino online que me regalaba 50 €. Volví a caer. Hice más de 300 operaciones en solo 3 meses, por un total de más de 17.000 €. Lo más grave: ese casino es ILEGAL en España.

📉 El banco lo sabía. Aun así, procesó todos los pagos.

Ni una llamada. Ni una alerta. Ni un bloqueo.

Al principio me devolvieron el dinero por ser una empresa ilegal… pero días después revirtieron todo sin avisarme, dejando mi cuenta en negativo.

He entregado pruebas, la denuncia, mi autoexclusión… y sigo sin respuesta clara.

That's how I understood it too, but not that the casino took it from him, but the bank. First it returned some money and then it took it out of the account again. I guess I got it right, but I guess we won't know what was behind it without the player.

I'm deeply sorry for what you're experiencing. Your testimony is invaluable because it highlights a reality that many prefer to ignore: the vulnerability of self-excluded people to aggressive advertising and the lack of effective controls, both on the part of illegal operators and the financial institutions that indirectly support them.

It's unacceptable that, despite the self-exclusion and the illegality of the casino in question, the banking system has allowed repeated transactions without triggering a single alert. According to the Spanish Gambling Law (Law 13/2011), operators must be licensed by the DGOJ (General Directorate of Legal Entities), and financial institutions should not process payments to unlicensed platforms. If you've already filed a complaint and your refund has still been reversed, you could also contact the Bank of Spain or even the European Ombudsman if Mastercard continues to fail to respond.

Tu testimonio es muy valioso porque pone en evidencia una realidad que muchos prefieren ignorar: la vulnerabilidad de las personas autoexcluidas frente a la publicidad agresiva y la falta de controles efectivos, tanto por parte de los operadores ilegales como de las entidades financieras que los respaldan indirectamente.

Es inaceptable que, pese a la autoexclusión registrada y la ilegalidad del casino en cuestión, el sistema bancario haya permitido transacciones reiteradas sin activar una sola alerta. Según la Ley del Juego en España (Ley 13/2011), los operadores deben tener licencia de la DGOJ, y las entidades financieras no deberían procesar pagos hacia plataformas sin licencia. Si ya presentaste denuncia y aún así se ha revertido el reembolso, podrías acudir también al Banco de España o incluso al Defensor del Pueblo Europeo si Mastercard continúa sin dar respuesta.
