Ciao a tutti,
Hello everyone,
thank you, Bons Casino, for your response and for confirming that you have reviewed my assessment.
However, I have to say that your latest response does not really address the specific concerns I raised. It essentially confirms that your Anti-Fraud team considers the activity abusive, but it does not explain what specific behaviour constituted the alleged abuse.
This is important because, based on the information you have provided to me, I still do not see a clear example of conduct that would reasonably constitute bonus abuse.
As I explained previously, the player reduced their bets after a significant win, but based on your own description, the difference in the bet size was only approximately $1. I do not consider such a relatively minor change in bet size to be sufficient, by itself, to demonstrate an abusive strategy.
Similarly, the fact that the player changed games after a significant win does not appear unusual to me. When playing slots, it is quite normal for a player to change games after a substantial win, whether because they feel they have already had a good result from that particular game, because they want to try another game, or simply because they want to vary their gameplay.
Therefore, I would like you to explain specifically what made this particular sequence of actions abusive, rather than simply confirming that your Anti-Fraud team classified it as such.
You state that you "understand the reasoning behind (my) position in this case". If so, I would appreciate it if you could address the reasoning directly and explain why the particular actions I have described should nevertheless be considered bonus abuse.
There is also an important issue regarding Section 10.2 of your Terms:
"Any free funds received from the Company (bonuses, comp points, etc.) also cannot be a subject for abuse by any means."
As I mentioned previously, I consider this wording extremely broad. It does not tell the player what specific behaviour constitutes "abuse" or what types of gameplay can result in the confiscation of winnings.
If this provision is intended to cover the type of conduct alleged in this complaint, I would like you to explain where in your Terms and Conditions this conduct is actually defined or described.
I have also reviewed Section 30.1.7, as I considered that this might contain a more specific description of the prohibited behaviour. However, I have still not been able to identify a particular rule there that clearly corresponds to the player's conduct in this case.
If you consider Section 30.1.7 to be the relevant provision, please identify the specific part of that section that you believe the player breached and explain precisely how the player's actions satisfy that provision.
Alternatively, if there is another section of your Terms that defines what you mean by "bonus abuse", please provide the relevant section and explain how it applies here.
I also want to make an important distinction regarding the player's winnings.
If the player followed the published bonus conditions, stayed within the applicable betting limits, completed the wagering requirements and subsequently won a significant amount, I do not believe that the casino can simply characterise the successful use of the bonus as "abuse" after the fact without identifying a specific prohibited action.
A player changing their bet size, changing games, or adjusting their gameplay after a substantial win can be entirely ordinary behaviour. If Bons Casino considers a particular form of such behaviour to be prohibited when bonus funds are involved, then I believe this needs to be clearly defined in the Terms so that players can reasonably understand the restriction before using the bonus.
At this stage, therefore, I am still unable to identify a sufficiently clear connection between the player's actual gameplay and a specific prohibited rule.
Bons Casino, I would appreciate one final, specific clarification:
Please identify the exact action or sequence of actions that you consider to constitute bonus abuse, identify the specific provision of your Terms that prohibits that conduct, and explain what advantage the player obtained through that conduct.
If Section 10.2 is the only basis for the decision, please also explain how you consider the very broad wording "abuse by any means" sufficiently specific to justify confiscating winnings in circumstances where the underlying conduct is not otherwise clearly defined in your Terms.
I am not asking you to change your internal Anti-Fraud assessment. I am asking you to explain the actual basis for it so that I can independently assess whether the confiscation was justified.
Based on the information currently available, I still believe the player's winnings should be paid out, as I have not been presented with sufficient evidence of actual bonus abuse.
I look forward to your specific clarification.
Thank you for your cooperation.
