On March 19, 2026, the Advocate General of the European Court of Justice delivered his opinion in case C-530/24. His reasoning confirms that aggrieved players have valid claims. According to the Advocate General, this applies even if errors were made by the German state in the licensing procedure.

The background to the proceedings is that gambling providers have been offering their services online without the required German license since at least 2012, thereby disregarding the player protection measures stipulated by the German state. The services were illegal.

The German state could hardly intervene in this situation, as its own errors in the licensing process had tied its hands. The players were at the mercy of the gambling providers; intended player protection regulations were rarely observed.

In particular, the defendant in the underlying proceedings (Tipico) has gained a significant market advantage in this way. Tipico has secured its market leadership through its illegal offerings and partial disregard for the player protection provisions of the 2012 Interstate Treaty on Gambling. As a result, thousands of players have suffered substantial losses.

Significant damage has been done to society. A substantial portion of German society has developed gambling disorders. According to the Gambling Atlas, as early as 2023, 2.3% of the population exhibited a gambling disorder – this represents 7.7% of all gamblers, or approximately 1.3 million people in absolute numbers. It is noteworthy that young men with low net household incomes and low levels of education are particularly vulnerable to developing gambling disorders. This target group has been specifically targeted by the gambling industry, whether in the selection of locations for land-based gambling establishments or in the advertising and design of online gambling. This targeting by gambling providers has paid off; individuals with problematic gambling behavior generate a high percentage of revenue. Depending on the form of gambling, this can amount to up to 76% of total revenue. The upcoming rulings of the European Court of Justice and the Federal Court of Justice also and especially concern these particularly vulnerable individuals.

The Advocate General of the European Court of Justice has now clarified that there are no obstacles under EU law to the recovery of losses from illegal gambling. Member States, including Germany, are free to strictly regulate access to gambling for providers in order to protect society. This regulation can also address claims for reimbursement if the service was offered illegally, contrary to the applicable regulations. The Advocate General thus confirms the legal opinion of the German Federal Court of Justice, which, in its referral to the European Court of Justice, already made it clear that it assumes a right to reimbursement of losses from illegal gambling.

As a rule, the European Court of Justice follows the Advocate General's opinion. It is therefore expected that a corresponding ruling from the ECJ will be issued shortly, confirming that German players will be compensated for the injustices they suffered and the losses incurred.

Am 19. März 2026 hat der Generalanwalt des Europäischen Gerichtshofs in der Sache C-530/24 seine Schlussanträge verkündet. Die Ausführungen bestätigen, dass Ansprüche von geschädigten Spielern bestehen. Dies gilt nach dem Generalanwalt selbst dann, wenn im Vergabeverfahren der Lizenzen durch den deutschen Staat Fehler gemacht worden sind.

Hintergrund des Verfahrens ist, dass Glücksspielanbieter mindestens seit dem Jahre 2012 ihre Angebote im Internet ohne die erforderliche deutsche Lizenz angeboten und dabei den vom deutschen Staat vorgesehenen Spielerschutz missachtet haben. Das Angebot war illegal. 

Der deutsche Staat konnte in dieser Situation kaum eingreifen, da ihm durch eigene Fehler im Vergabeverfahren der Lizenzen die Hände gebunden waren. Die jeweiligen Spieler waren dem Verhalten der Glücksspielanbieter ausgeliefert; vorgesehene spielerschützende Regelungen wurden selten eingehalten.

Insbesondere die im zugrunde liegenden Verfahren Beklagte (Tipico) hat sich auf diese Art und Weise einen erheblichen Marktvorteil verschafft. Tipico hat sich durch das illegale Angebot und die teilweise Missachtung der spielerschützenden Normen des Glücksspielstaatsvertrages 2012 die Marktführerschaft gesichert. Dabei sind bisher tausende Spieler mit erheblichen Verlusten auf der Strecke geblieben.

Für die Gesellschaft sind erhebliche Schäden entstanden. Wesentliche Anteile der deutschen Gesellschaft haben Glücksspielstörungen entwickelt. Nach den Erhebungen  des Glücksspielatlas wiesen bereits im Jahre 2023 wiesen 2,3 % der Bevölkerung eine Glücksspielstörung auf – von allen Glücksspielenden sind dies 7,7 % oder in absoluten Zahlen ca. 1,3 Millionen Personen. Bemerkenswert ist insofern, dass besonders vulnerabel für die Entwicklung von Glücksspielstörungen junge männliche Personen sind, die ein geringes Haushaltsnettoeinkommen und ein geringes Bildungsniveau aufweisen. Diese Zielgruppe der Glücksspielindustrie wurde gezielt adressiert, sei es bei der Auswahl des Standortes eines terrestrischen Spielangebotes oder bei der Werbung für und der Ausgestaltung von Online-Glücksspielen. Dieses Targeting der Glücksspielanbieter zahlte sich aus; Personen mit einem problematischen Glücksspielverhalten generieren einen hohen Umsatzanteil. Je nach Form des Glücksspiels beträgt dieser bis zu 76 % des Gesamtumsatzes. Bei den anstehenden Entscheidungen des Europäischen Gerichtshofs und des Bundesgerichtshofs geht es auch und insbesondere um diese besonders anfälligen Personen.

Der Generalanwalt des Europäischen Gerichtshofs stellt insofern nunmehr klar, dass europarechtlich keine Hindernisse bestehen, die gegen eine Rückforderbarkeit der Verluste aus dem illegalen Glücksspiel sprechen. Den jeweiligen Mitgliedstaaten, also auch Deutschland, steht es offen, den Zugang zum Glücksspiel für Anbieter zum Schutze der jeweiligen Gesellschaft streng zu regulieren. Dabei können auch Rückforderungsansprüche geregelt werden, sofern das Angebot entgegen der vorgesehenen Regulatorik illegal angeboten wurde. Der Generalanwalt bestätigt also die Rechtsauffassung des Bundesgerichtshofs, welcher bereits im Rahmen seiner Vorlage an den Europäischen Gerichtshof deutlich gemacht hat, dass er von einem Anspruch auf Rückerstattung von Verlusten aus illegalem Glücksspiel ausgeht.

In aller Regel folgt der Europäische Gerichtshof den Schlussanträgen des Generalanwalts. Es ist daher damit zu rechnen, dass in Kürze eine entsprechende Entscheidung des EuGH erfolgen wird, die deutschen Spielern bestätigt, dass erfahrenes Unrecht und entstandene Verluste entschädigt werden.

If I chargeback, do I go goods/services not received. Not had luck with my other back on being honest and mentioning MCC incorrect.

Ok so finding the directors and address could lead to finding the site. Early last year I had a lot of luck with refunds.

Including DSSERVELTD, A55, Quantum Grid Labs, Depasify, WBMSC, FreshBet, Coresbyte, BestFM, Kashia, but seemed easier to find the sites compared to how this is... as only really finding the payment processors.

Also difficult to know which successful transactions are linked to which payment processor, and all just say PRILING, Gloucester on those ones above
